Conflicts of Interest: Loyalty and Independent Judgment


Program Description:
An overview of how to identify and resolve conflicts of interest under the Illinois ethics rules including: practical advice on representing multiple clients; when to do a conflicts check; determining when a conflict can be waived; getting clients informed consent to a waiver; and how to set up a law firm's conflicts checking system.

Program Objectives:                                                   
  • Learn what the conflicts rules are, the rationale under the rules, why the rules are there, and how to adhere to the conflicts rules in four different settings: current clients, former clients, prospective clients and common law areas.
  • Apply your duty of loyalty and independent judgment to your client matters.
  • Reflect on the recommendations made from experienced practitioners and the precedent discussed.
