The Ethical Requirements of Handling Trust Funds Under ILRPC 1.15



Program Description:
The mishandling and, unfortunately, the misappropriation, of client trust account funds, is often the number one area of complaint that leads to formal disciplinary trouble for attorneys. But the handling of client trust funds is not as scary or difficult as you might think. This program provides a breakdown of the basic requirements of ILRPC 1.15 and addresses common issues attorneys encounter when dealing with the ethical requirements of handling client trust funds.

Program Objectives:
  • Learn the requirements of ILRPC 1.15, the steps to opening an IOLTA account, the recordkeeping requirements, and other related issues including: overdraft investigations, the unidentified funds amendment to ILRPC 1.15, handling retainers, where to deposit advances for legal fees and handling credit card payments.
  • Apply the guidance on ILPRC 1.15 to the maintenance of your client trust account.
  • Reflect on the provided resources and ARDC publications to ethically handle your client trust account.
  • In addition, you will be provided with information on recent email scams designed to entrap lawyers into sending funds from their client trust account under false pretenses.
